This Membership Agreement (the Agreement) is effective December 12th, 2020 by and between The Sindome, hereinafter referred to as "Game" or "The Game", accessed via the Internet at www.sindome.org, moo.sindome.org and play.sindome.org and other related websites and all current and future members of Sindome hereinafter referred to as "Member".
By access, browsing or using the www.sindome.org, moo.sindome.org, grid.sindome.org, or other websites run by The Game or directly connecting via telnet or other protocol to moo.sindome.org or by selecting I Accept during the Member Signup Process (Signup), you represent that you have read, understand and agree to be bound by the terms and conditions of this Membership Agreement hereinafter referred to as "Agreement".
Member shall fill in the correct information requested in the Member Signup Process (Signup) when registering at www.sindome.org. Member shall provide an accurate email address that they reasonably expect will be able to receive password reset emails and other game related correspondence in the future. Member shall select a Member Username and password during Signup. Member shall be responsible for: a) all use of game sites made by the Member using Username and password, and b) maintaining the confidentiality of the Member Username and password.
The Content includes messages and other materials posted to forums, groups, nodes and other locations maintained by the Game. Members grant the Game a nonexclusive license to post, display, copy and modify the Content in connection with the operation of Sindome sites and the Game. Further, the Member is deemed to grant the game the nonexclusive right to post, display, copy and sell the Content unless otherwise limited by the Member during the act of contributing the Content via whatever means are utilized. Member is also deemed to authorize the game to disclose his/her personal data when the Member chooses to include such personal data in the Content. Any contributions to Sindome via the website, or the Game, made by the Member, are the property of Sindome and cannot with withdrawn without explicit permission from a Senior member of the Game staff.
If the Member has a dispute with one or more other Members, the Member shall release the Game (and its staff, admin, directors, agents, subsidiaries, joint ventures and potential employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
The Game shall not sell or rent Member's personal information to third parties without Members explicit consent. The Game shall store and process Member information on computers located in the United States that are protected by physical as well as technological security devices. However, the Game shall be permitted to access and modify Member's information in accordance with Game business and Game policy.
Member shall indemnify and hold the Game (and its staff, admin, officers, directors, agents, subsidiaries, joint ventures and employees) harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Member's breach of this Agreement, or Member's violation of any law or the rights of a third party.
No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
Member shall choose to retire from the Game by ceasing to contribute Content and not logging into their Game account for a period of 100 days. Terms regarding the status of any contributed Content shall remain applicable when the Member chooses to terminate the membership. Content posted to any Game site or digital property shall not be deleted or retired as a result of Member's termination. Members may have their membership and access to the website, forums, bulletin boards and game world revoked or restricted at any time by Staff Members for violating the Rules of Conduct.
This Agreement shall be construed under and governed in accordance with the laws of the State of Massachusetts.
Member shall not hold The Game responsible for other Member's Content, actions or inactions.
